China MPS Notice: The Administrative Measures for Purchasing and Transporting Licenses of Highly Toxic Chemicals (Revised Draft) Seeking Public Consultation

September 5th 2014, The Chinese Ministry of Public Security (MPS) published a notice to collect public advice for the Administrative Measures for Purchasing and Road Transporting of Highly Toxic Chemicals (Revised Draft).

It has been around 9 years since the old version of the Administrative Measures for Purchasing and Highway Transporting Licenses of Highly Toxic Chemicals (MPS Order No. 77) was enacted. The implementation of this order not only provided the legal basis for the strict management of highly toxic chemicals, but also effectively prevented the accidents involved highly toxic chemicals from happening. However, it is undeniable that the old version of the order has deficiencies to some degrees, thus, corresponding amendments should be made. Hence, the Administrative Measures for Purchasing and Road Transporting Licenses of Highly Toxic Chemicals (Revised Draft) was issued to seek public consultation.

Compared with the former version, the latter one mainly revised in the following aspects:

1. The amendment of name. The revised draft uses road to replace highway in the title of the order, for they think road including highway and other kinds of land ways.

2. Making the liabilities and authorities of related departments more explicit. The draft regulation stipulates that public security sectors are responsible for the purchase-relevant affairs while transportation bureaus are in charge of traffic-permit licenses.

3. Adjusting the purchasing and transporting procedure of highly toxic chemicals. The new administrative measures require corporations who need to buy or sell highly toxic chemicals (HTC) must obtain all related licenses, such as HTC safe use permit, HTC operating licenses and so on.

4. Some new road transporting requirements are added. Only the vehicles which get HTC transporting permit can do the transport, regardless of the quantity of HTC.

5. Several new administrative measures are established. For example, after selling and purchasing of HTC, related information must be submitted to local public security bureaus to get a record.
