China Released the "List of Chemicals under Priority Control (first batch)"

To implement the "Action Plan for Prevention and Control of Water Pollution" (order No.17 [2015] of the State Council), MEP, in conjunction with MIIT and NHFPC, formulated the "List of Chemicals under Priority Control (first batch)" (the "List") which is hereby issued.

The first "List" contains 22 types of chemicals. For the 22 types of chemicals will be listed in the "List of State-encouraged Substitutes for Toxic and Hazardous Raw Materials (Products)", corresponding national mandatory standards will be revised and released to restrict their use in some products. It is expected that enterprises using the 22 types of chemicals will be required to apply for the pollution discharge permit, be supervised by relevant departments and be compulsively checked on the cleaner production. Manufacturing enterprises producing products which are listed in the "List" will suffer many limitations during the production process. If mixtures produced or imported by enterprises contain substances in the "List", the enterprises will be influenced as well, and may be controlled of environmental protection tax in the future.

Risk control measures for chemicals under priority control

The "List" focuses on chemicals that have significant inherent hazard properties, are likely to persist in the environment and may cause greater risks to the environment and human health. Risk control measures shall be adopted for main segments of environmental and health risks caused by chemicals included in the "List" to reduce the impact on people's health and the environment caused by the production and use of chemicals to the minimum.

1. Implement the discharge permit system

"Atmospheric Pollution Prevention and Control Law of the People's Republic of China": MEE shall, in conjunction with NHFPC, publicize the "List of Toxic and Harmful Atmospheric Pollutants". Units discharge pollutants included in the list shall obtain the pollutant discharge permit before discharge.

"Water Pollution Prevention and Control Law of the People's Republic of China": MEE shall, in conjunction with NHFPC, publicize the "List of Toxic and Harmful Water Pollutants". Units, other producers and operators who discharge pollutants included in the list shall monitor on the pollution discharge outlets and surrounding environment, make the information of toxic and harmful water pollutants public, and take measures to prevent environmental risks. Relevant units shall obtain the pollutant discharge permit before discharge.

2. Take restrictive measures

Relevant national mandatory standards shall be revised to restrict the use in certain products.

  • Encourage to replace

Relevant chemicals will be included in the "List of State-encouraged Substitutes for Toxic and Hazardous Raw Materials (Products)"

  • Conduct cleaner production review and information publicity system

"Cleaner Production Promotion Law of the People's Republic of China": Enterprises that use toxic or harmful raw materials for production or discharge toxic or harmful substances in production shall conduct mandatory cleaner production review.

"Measures for Cleaner Production Review": Enterprises that use toxic or hazardous raw materials for production or discharge toxic or hazardous substances in production shall conduct mandatory cleaner production review. These enterprises shall publicize enterprise information in a manner that is easily accessible to the public, including the names, quantities and uses of toxic and hazardous raw materials used, as well as the names, concentrations and quantities of toxic and hazardous substances discharged.
