China State Council adds 2-Chlorophenyl cyclopentyl ketone to the list of category I precursor chemicals

21 Sept 2012, China State Council has approved to list 2-Chlorophenyl cyclopentyl ketone, with CAS 6740-85-8 and HS code 2914399014, in the first category of precursor chemicals in Regulation on the Administration of Precursor Chemicals. This will impose strict management on commercial activities like manufacturing, transportation, operating and import/export from 15th Sep 2012.

It is required the manufacturers/ operators of 2-Chlorophenyl cyclopentyl ketone shall apply for manufacturing/operating licenses with administrative department of work safety at provincial level. Import/Export companies of 2-Chlorophenyl cyclopentyl ketone shall apply for import/export certificate with State Administrative Department of Commerce. Companies are required to apply for purchasing/transportation certificate with administrative department of public security for purchasing/transportation activities.

Companies violating this regulation may get fined of 10 times up to 20 times of the commodity value of the precursor chemicals. The authority may cease the acceptance of its application for a license of production,operation, purchase, transportation or import or export of precursor chemicals during the next 3 years. The individual violator may be subject to criminal liabilities where a crime is constituted.

CIRS’s Comments

China imposes strict regulatory management on precursor chemicals. Recently, it is required to provide full name of the buyer when purchasing medicines for cold with ephedrine ingredients. Since the Catalogue of Classification and Varieties of Precursor Chemicals is updates regularly, CIRS suggest companies shall pay more attention to this catalogue and know clearly about the responsibilities and liabilities.
