AQSIQ Issued Measures for the Supervision and Administration of Import and Export Food Safety (draft) for WTO Notification

On September 13 2017, AQSIQ Issued Measures for the Supervision and Administration of Import and Export Food Safety (draft) for WTO Notification and the final date for comments is November 11, 2017.

Article 5

(Supervision Method)

The supervision and management of inspection and quarantine for import and export food (excluding food additives and food-related products) will be carried out by qualification assessment. Qualification assessment activities include but not limited to: export country (region) system assessment, overseas food production enterprise registration, import and export enterprise filing, quarantine approval, export country (region) official certificate verification, attached conformity certificate material verification, document review, site inspection, supervision and sampling, import and sales record inspection, etc.

Article 8

(Standard Requirement)

I. Imported food shall comply with current laws, regulations and national food safety standards in China.

II. Imported food without corresponding national food safety standards shall comply with the temporarily available standard provided by Health Administration Department of the State Council.

III. New food raw materials or food produced by new food raw materials should go through the safety review carried out by Health Administration Department of the State Council before importing.

Article 14

(Pre-inspection)

On the basis of risk analysis, according to the application of food importers or agents, the imported food can be pre-inspected and quarantined by CIQ or the qualified third-party inspection institution. When importing pre-inspected food, CIQ will provide more convenience on customs clearance.

Article 15

(Conformity Certificate Materials)

Imported food shall provide the attached conformity certificate materials according to the requirement of CIQ, including:

(1)Declaration of conformity;

(2)Inspection report;

(3)Certificate documents issued by the competent authority of the export country (region) or its authorized institution.

The form, contents and comments of the certificate documents shall be determined by AQSIQ and the competent authority of the export country (region) together.

Article 18

(Declaration for Inspection)

The importer should apply to CIQ for inspection, following materials need to be provided:

(1)Those who need to apply for entry animal and plant quarantine approval procedures shall provide entry animal and plant quarantine permits;

(2)Those who import food that required relevant review shall provide license documents issued by related department designated in laws;

(3)The name of the overseas exporter or agent, the filing number of the importer, the registration number of the overseas food production enterprise

(4)If the export country (region) is required to issue supporting documents, the corresponding supporting documents should be provided;

(5)Those who import prepackaged food should provide the supporting documents that its Chinese label and the specification can comply with the laws and regulations in China;

(6)The related conformity certificate materials for food with high risk or other special requirements.

2. Summary

I. AQSIQ issued Administrative Measures for Imported Food Attached Certificates (Draft) for WTO notification in June, the Measures for the Supervision and Administration of Import and Export Food Safety (draft) issued this time also includes some content relevant to the conformity certificate materials that needed for imported food.

II. CIQ encourage enterprises to carry out pre-inspection for imported food, which can help to improve the customs clearance efficiency.

III. The draft stresses the importance of the compliant Chinese label for imported food and the standard requirement once again, enterprises need to pay attention.
