Revised Toxic Chemical Substances Control Act (TCSCA) in Taiwan

Labor Safety and Health Act(LSHA) was initially implemented on 16 April 1974 to protect worker safety. The latest amendment was published on 3 July 2013 and it was renamed as Occupational Safety and Health Act (OSHA) in the latest amendment. This regulation mainly focuses on workplace safety and chemical management is part of it.

Chemical Management Under OSHA

The following chemical management requirements are from the new OSHA.

  • Manufacturers or importers shall NOT manufacture or import a new chemical substance prior to submitting hazard and labor risk assessment report and obtaining the approval for new substances (not listed in the inventory).
  • Employers shall disclose hazard and risk info of the registered new chemical substance for the purpose of protecting Labors' safety and health.
  • The manufacturer, importer, supplier or employer shall submit relevant operation data of priority management chemical substances designated by competent authority.
  • The manufacturer, importer, supplier or employer shall apply for permit for handling designated controlled chemical substances published by the central competent authority.e.g. CMR: carcinogenic, mutagenic or toxic for reproduction, EDC and exposure concerned chemical substances (asbestos etc.).
  • Employers shall provide label and SDS with the chemicals classified as hazardous.
